With reference to correspondence ending with your

letter of 20th February 1915/22, relative to the Hong
Kong Deportation Ordinance 1921, I am directed by the
Secretary of State for India to state, for the information
of the Secretary of State for the Colonies, that he has
consulted the Government of India by telegraph regarding
paragraph (b)-of Section 3 of this Ordinance which
provides for the addition to Sub-section (14) of Section 4
of the principal Ordinance of a paragraph (e) dealin with
the deportation of seditious persons.

In reply the Government of India while not objecting to
the deportation provided for by the ordinance press
judicial enquiry in such cases similar to that laid down in
the China (Amendment) Order in Council 1920. In order to
meet the wishes of the Government of India, I am to suggest
for the consideration of Hr.Secretary Churchill that the
proposed ordinance should be modified so as to prescribe a
judicial enquiry and an order by a Court in the cases
referred to.
